1. Acceptance of Terms

By accessing or using BrighterBrains™, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use this platform.

2. Description of Service

BrighterBrains™ is a subscription-based cognitive training platform offering exercises, games, articles, and general wellness information. The platform is designed for:

• Mental stimulation and cognitive fitness activities
• Entertainment and educational purposes
• General wellness support as part of a healthy lifestyle

BrighterBrains™ is adjunctive only and should be used as part of a comprehensive approach to wellness that includes proper medical care, physical exercise, healthy diet, social engagement, and other lifestyle factors.

3. No Medical Advice

Content on BrighterBrains™, including information from the AI Coach ("Hop"), is for general informational and educational purposes only. It does not constitute medical, psychiatric, psychological, or nutritional advice.

You acknowledge and agree that:

• BrighterBrains™ does not create a doctor-patient or healthcare provider relationship
• No content should be used for self-diagnosis or self-treatment
• You will consult appropriate healthcare professionals for medical concerns
• Individual results vary and are not guaranteed
• Cognitive training exercises improve performance on trained tasks but may not transfer to real-world cognitive abilities

4. User Eligibility and Representations

By using BrighterBrains™, you represent and warrant that:

• You are at least 18 years of age
• You are using this platform for personal wellness and entertainment
• You understand this is not a medical device or therapeutic intervention
• You will not rely on this platform in place of professional medical care

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHTERBRAINS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the service
• Any health or medical outcomes
• Unauthorized access to your data
• Any reliance on content provided through the platform

6. No Guarantees or Warranties

BrighterBrains™ is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant or guarantee:

• Specific cognitive improvements or outcomes
• Prevention, delay, or reduction of disease risk
• Transfer of training gains to real-world abilities
• Improvement in daily functioning or quality of life
• Accuracy of assessments or recommendations

Individual results vary. Past performance does not predict future results.

7. User Responsibilities

You agree to use BrighterBrains™ responsibly and acknowledge that:

• You are solely responsible for your health decisions
• You will seek professional medical advice for any health concerns
• You will not use the platform as a substitute for medical care
• You understand cognitive training is most effective as part of a comprehensive wellness approach

8. Subscriptions, Automatic Renewal, Price Changes and Refunds

8.1 Automatic renewal

Paid plans renew automatically at the end of each billing period (monthly or yearly, as shown at checkout) and are charged to your payment method on file until you cancel. Before you pay, we show the price, billing frequency, renewal terms and how to cancel, and we ask for your consent.

8.2 Founding price

Founding Plus ($99/year) and Founding Family ($199/year) are available to the first 500 founding memberships (Plus or Family) or until December 31, 2026 (11:59 p.m. Central Time), whichever comes first. The founding price is locked for your first two yearly billing periods. Starting with your third year, the price is $129/year (Plus) or $299/year (Family) for as long as you stay subscribed without a break. If your membership ends (by cancellation, refund or failed payment that isn't fixed), the founding and post-founding prices no longer apply, and rejoining is at the then-current list price.

8.3 Reminders and price changes

We email a reminder before each yearly renewal stating the plan, amount, renewal date and how to cancel. We notify you at least 7 and no more than 30 days before any price change takes effect, including the scheduled change in 8.2.

8.4 Cancellation

You can cancel online at any time in Account settings → Subscription → Cancel, or by emailing support@brighterbrains.app. Cancellation stops future renewals. You keep access through the end of the period you already paid for. Except as stated in 8.5, we do not give partial or prorated refunds.

8.5 30-day money-back guarantee

If you request a refund within 30 days after your first payment for a paid plan, we refund that first payment in full, no questions asked, and cancel your membership (including Family members' access). The guarantee applies once per customer and does not apply to renewal payments. See our Refund Policy at brighterbrains.app/refunds.

9. Modifications to Service and Terms

We reserve the right to modify or discontinue the service or these Terms at any time. Continued use after changes constitutes acceptance of modified Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which BrighterBrains™ is registered, without regard to conflict of law provisions.
